1. Agreement to Terms

This Terms of Service Agreement ("Agreement") constitutes a legally binding contract between you ("User") and DC Cloud Tech Ltd, operating the FAYTISH application and services ("FAYTISH," "we," "us," or "our"). This Agreement governs your access to and use of the FAYTISH mobile application, website, and related services (collectively, the "Service").
By accessing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions set forth herein. If you do not agree to these terms, you may not access or use the Service.

2. Eligibility and Registration

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. By registering, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this Agreement.
To create an account, you must provide a valid email address and accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. User-Generated Content

You may post, upload, share, or transmit content such as text, photos, videos, and event information ("User Content"). You retain ownership of the intellectual property rights in your User Content.
By submitting User Content, you grant FAYTISH a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating, promoting, and improving the Service.
You are solely responsible for your User Content and its legality. You agree not to post User Content that:

• Infringes any third-party right, including intellectual property or privacy rights.
• Is unlawful, harassing, hateful, racially or ethnically offensive, or promotes violence or illegal activity.
• Is sexually explicit, obscene, or pornographic.
• Contains false information or impersonates any person or entity.

We reserve the right, but are not obligated, to review, monitor, or remove any User Content at our sole discretion, without prior notice.

4. Events and Third-Party Listings

The Service provides a platform for users to create, discover, and share information about third-party events, venues, and gatherings. FAYTISH does not host, organize, endorse, or assume any responsibility for any such event, venue, or listing. All interactions and agreements regarding participation, payment, safety, or conduct at any event are solely between you and the event organizers or other attendees. You attend any event at your own risk.

5. Prohibited Conduct

You agree not to engage in any of the following activities in connection with the Service:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Harass, abuse, threaten, or harm other users.
• Use automated scripts, bots, scrapers, or other means to access the Service or collect user data.
• Attempt to circumvent any content-filtering techniques or security measures.
• Interfere with or disrupt the integrity or performance of the Service.
• Upload or transmit viruses, malware, or any other malicious code.

6. Purchases, Subscriptions, and Virtual Items

6.1. Purchases

FAYTISH may offer paid subscriptions (e.g., VIP memberships) and virtual items (e.g., credits) for purchase ("Purchases").

6.2. Billing and Auto-Renewal (Subscriptions)

Subscriptions automatically renew at the end of each billing cycle (e.g., monthly, quarterly) unless you cancel auto-renewal at least 24 hours before the current period ends. You authorize us to charge the applicable fee to your designated payment method upon each renewal.

6.3. Payment Processing

Purchases may be processed:

• Via External Stores:Through platforms like the Apple App Store or Google Play Store, subject to their respective payment terms and conditions. You must manage cancellations through your account with that store.
• Directly:Via credit card or other methods within the FAYTISH service.

6.4. Pricing

Prices may vary by region and are subject to change. Promotional offers may not apply to renewals.

6.5. No Refunds

All purchases are generally final and non-refundable, except as legally required.

• EU/UK/Switzerland/EEA Users:You have a legal right to a full refund within 14 days of a subscription purchase.
• Republic of Korea Users:You have a legal right to a full refund for subscriptions and unused virtual items within 7 days of purchase.
• Other Jurisdictions:Specific local laws (e.g., in Arizona, California, Israel) may provide additional refund rights.
• Refund Requests:For purchases made via an External Store, direct refund requests to that store's support. For direct purchases, contact FAYTISH support.

6.6. Virtual Items

Purchased virtual items are digital licenses for use solely within the Service. They are non-transferable, non-refundable, and have no cash value. We may modify or discontinue virtual items at any time.

7. Termination

You may terminate your account at any time through the in-app settings or by contacting us. We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach this Agreement.

8. Privacy

Your privacy is important to us. Our collection, use, and disclosure of your personal information are governed by our Privacy Policy, which is incorporated into this Agreement by reference.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, FAYTISH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THE ACCURACY, SAFETY, OR CONDUCT OF ANY USER OR THIRD-PARTY EVENT.
IN NO EVENT SHALL FAYTISH, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Modifications to the Agreement

We may modify this Agreement at any time. We will provide notice of material changes by updating the "Last Updated" date and/or posting a notice within the Service. Your continued use of the Service after such changes constitutes your acceptance of the revised Agreement.

11. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of [Insert Jurisdiction, e.g., Hong Kong Special Administrative Region], without regard to its conflict of law principles.
